Texas divorce law allows for a no-fault or fault-based divorce.

No-fault divorce is a marital termination proceeding where you do not need to prove grounds for a divorce or show that the other spouse caused the breakdown of the marriage through adultery, cruel treatment, abandonment or other reasons.

Under Texas no-fault rules, one spouse may obtain a divorce if their marriage has become "insupportable" or if the couple has been living apart for three years, even if the other spouse does not want the divorce. Prior to the filing of the petition for divorce in Texas, one of the parties must have resided in the county of filing for 90 days and have been a resident of the state of Texas for a continuous six months.

These are the grounds for a divorce in Texas:

  • Insupportability without regard to fault.
  • Adultery.
  • Cruelty.
  • Conviction of a felony.
  • Abandonment, if the abandoning spouse left the complaining spouse with the intention of abandonment; and remained away for at least one year.
  • Living apart for at least three years.
  • Confinement in a mental hospital for at least three years because of a mental disorder that is unlikely to be cured or a relapse is probable.
